Mental Capacity, Protective Matters & Court of Protection

Our work begins with the needs of individuals and families in the Caribbean. We advise on questions of mental capacity, decision-making, powers of attorney, management of property and financial affairs, and concerns about the protection of vulnerable people. Where assets, relatives or legal arrangements span more than one country—for example, Grenada and England and Wales—we assist clients in understanding the issues in each jurisdiction and coordinating the appropriate next steps.

OUR CARIBBEAN AND CROSS-BORDER APPROACH

Protective procedures, the powers of attorneys and court-appointed decision-makers differ across Caribbean jurisdictions. We assess the relevant local framework and, where a matter also engages England and Wales, consider how its Court of Protection, deputyship or lasting power of attorney arrangements may interact with Caribbean property and family affairs. Representation and court applications are undertaken only where the relevant practitioner or practice is authorised to do so.

Where more than one jurisdiction is involved

A power of attorney, deputyship order or other protective arrangement made in one country may not automatically have effect in another. We help clients identify the relevant local requirements and obtain appropriate advice before action is taken in relation to overseas assets or individuals.
